2. Eligibility

You must be at least 18 years old and legally able to enter into contracts in your jurisdiction. By using PropMarket, you represent that you meet these requirements. PropMarket accounts are available to individuals worldwide, subject to applicable local laws and regulations.

3. Description of Services

PropMarket provides funded trading accounts for prediction markets, including but not limited to Kalshi and Polymarket. Users may purchase evaluations, and upon successful completion, receive access to funded accounts with PropMarket's capital. PropMarket is not a broker, exchange, or financial advisor.

4. Account Registration

You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized access.

5. Evaluation and Funding

Evaluation parameters, profit targets, drawdown limits, and account sizes are described on our pricing page and may be updated at our discretion. Passing an evaluation does not guarantee indefinite access to a funded account. PropMarket reserves the right to modify evaluation criteria, funded account terms, and profit-split ratios with reasonable notice.

6. Trading Rules

Funded traders must adhere to all trading rules outlined during onboarding, including maximum drawdown limits, prohibited trading strategies, and position size restrictions. Violation of trading rules may result in account suspension or termination without refund.

7. Prohibited Conduct

• Manipulating or attempting to manipulate evaluation results
• Using multiple accounts to circumvent trading rules
• Sharing account credentials with third parties
• Engaging in any form of market manipulation
• Using automated trading systems without prior approval
• Any activity that violates applicable laws or regulations

8. Intellectual Property

All content, trademarks, logos, and materials on PropMarket's website are owned by or licensed to PropMarket and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law, PropMarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to lost profits, data loss, or business interruption.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Services ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes take effect upon posting to our website. Continued use of the Services after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration.

1. Nature of Prediction Markets

Prediction markets involve buying and selling contracts based on the outcome of future events. Contract values fluctuate based on market sentiment, news, and other factors. Past performance is not indicative of future results.

2. Risk of Loss

While PropMarket provides funded accounts (meaning you trade with our capital, not your own), there are still financial risks involved:

• Evaluation Fees: The fee paid for an evaluation is non-refundable if you fail to meet the profit target or violate trading rules (see Refund Policy for exceptions).
• Account Termination: If you exceed maximum drawdown limits, your funded account will be suspended and you will need to purchase a new evaluation.
• No Guaranteed Income: There is no guarantee that you will earn profits on a funded account.

3. Market Risk

Prediction market prices can move rapidly and unpredictably. Events such as breaking news, policy changes, natural disasters, and other developments can cause sudden and significant price movements. Liquidity may vary across markets and time periods.

4. Platform Risk

PropMarket relies on third-party prediction market platforms (including Kalshi and Polymarket) for trade execution. We are not responsible for platform outages, execution delays, or technical issues on these third-party platforms.

5. Regulatory Risk

Prediction markets are subject to evolving regulations. Changes in laws or regulations in your jurisdiction may affect your ability to trade or access certain markets. It is your responsibility to ensure compliance with local laws.

6. No Financial Advice

PropMarket does not provide financial, investment, tax, or legal advice. Content on our website, in our community, or from our team is for informational and educational purposes only. You should consult qualified professionals before making financial decisions.

7. Simulated vs. Live Trading

Evaluation accounts use simulated trading environments. Performance during evaluation may not reflect performance in live funded accounts due to differences in execution, liquidity, and market conditions.

8. Personal Responsibility

You are solely responsible for your trading decisions. PropMarket provides the capital and infrastructure but does not direct or recommend specific trades. You acknowledge that you understand the risks involved and accept full responsibility for your trading activity.

Refund Policy

1. Evaluation Purchases

All evaluation purchases are final and generally non-refundable once the evaluation has been activated and trading has commenced.

2. Eligible Refunds

You may be eligible for a full refund in the following circumstances:

• Before Activation: If you request a refund before your evaluation account has been activated (i.e., before your first trade), you are eligible for a full refund.
• Technical Issues: If a verified platform-side technical issue prevented you from completing your evaluation fairly, we will offer either a refund or a free evaluation reset at your choice.
• Duplicate Charges: Accidental duplicate purchases will be refunded promptly.

3. Non-Refundable Scenarios

• Failing to meet evaluation profit targets
• Exceeding maximum drawdown limits
• Violation of trading rules resulting in account termination
• Change of mind after activation
• Dissatisfaction with trading performance

4. Free Retries and Resets

PropMarket may offer promotional free retries or discounted re-evaluations at our discretion. These offers are communicated through our website and Discord community.

5. Refund Process

To request a refund, open a ticket in our Discord server. Refund requests are reviewed within 3 business days. Approved refunds are processed within 7 business days to your original payment method.

6. Changes to This Policy

We reserve the right to modify this Refund Policy at any time. Changes will be posted on our website and take effect immediately. Purchases made before a policy change will be governed by the policy in effect at the time of purchase.
